1. Scope and Provider
1.1 These General Terms and Conditions (AGB) apply to all orders placed through our online store frenchformulas at frenchformulas.com.

1.3 Deviating conditions of the customer shall not be recognized unless expressly agreed to in text form.
2. Eligibility to Purchase
The products offered in our online store are intended exclusively for customers who have reached 18 years of age.
3. Conclusion of Contract
3.1 The presentation of products in the online store does not constitute a legally binding offer, but an invitation to place an order.
3.2 You can place products in the shopping cart and proceed to checkout. There you enter your contact, delivery, and payment details. Before submitting your order, you will see a summary of your order where you can check all information and correct any errors using the edit functions or your browser's back button.
3.3 By clicking the purchase button ("Order with obligation to pay"), you submit a binding offer to purchase the products in your shopping cart.
3.4 The contract is concluded when we confirm your order by email (Order Confirmation) or by dispatching the goods to you.
4. Contract Language and Storage of Contract Text
4.1 The contract languages are German and English.
4.2 We store the contract text. You will receive the order details and these Terms and Conditions by email with the order confirmation. You can also view and print these Terms and Conditions at any time on this page. If you have created a customer account, you can view your past orders there.
5. Products and Availability
5.1 We offer high-quality skincare and cosmetics from French pharmacies as well as products under our brand **French Formulas**.
5.2 Product illustrations may differ slightly in color and packaging design from the delivered goods, particularly when manufacturers update their packaging. The information provided in the product description is decisive.
5.3 If an ordered product is not available, we will inform you immediately. Any payments already made will be refunded promptly.
6. Prices and Shipping Costs
6.1 All prices are final prices and include the statutory Value Added Tax (VAT).
6.2 Additional shipping costs apply, which are displayed on our shipping information page and during checkout prior to placing the order.
6.3 For deliveries to countries outside the European Union, additional customs duties, taxes, or fees may apply, which are to be borne by you.
7. Payment Methods
7.1 You may pay using Shopify Payments, PayPal, Klarna, as well as any other payment methods displayed at checkout.
7.2 When paying via PayPal or Klarna, the additional terms and conditions and privacy notices of the respective payment service provider apply.
8. Delivery
8.1 We deliver within Germany, to the European Union, and to selected international countries. Available delivery destinations are shown at checkout.
8.2 Unless stated otherwise on the product page, the delivery time within Germany is 1 to 3 business days from the conclusion of the contract (in the case of advance payment, from receipt of payment). Delivery times for other countries are displayed on the shipping information page.
8.3 Please ensure that your delivery address is accurate and complete.
9. Retention of Title
The delivered goods remain our property until full payment has been received.
10. Right of Withdrawal (Cancellation Policy)
10.1 As a consumer, you have a statutory right of withdrawal of 14 days. Details can be found in our separate Cancellation Policy (Widerrufsbelehrung).
10.2 **Expiry of the Right of Withdrawal for Cosmetics:**
The right of withdrawal expires prematurely in the case of contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal (e.g., protective foil, hygiene sticker, or seal tab) has been removed after delivery.
10.3 Please return products in their original packaging whenever possible. This is not a formal requirement for exercising your right of withdrawal.
10.4 You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
11. Warranty and Transport Damage
11.1 Statutory warranty rights (Mängelhaftungsrecht) apply.
11.2 If goods are delivered with obvious transport damage, please report this immediately to the carrier and contact us as soon as possible. Failure to make a complaint or contact us does not affect your statutory warranty rights.
12. Liability
12.1 We are unreservedly liable for intent and gross negligence, for injury to life, body, or health, as well as under the German Product Liability Act (Produkthaftungsgesetz).
12.2 In cases of slight negligence involving a breach of essential contractual obligations (obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance you may regularly rely), our liability shall be limited to foreseeable, typical contractual damages.
12.3 Otherwise, liability for slight negligence is excluded.
13. Intellectual Property and Trademarks
All content on this website, including texts, images, graphics, logos, and designs, is protected by copyright law. The trademarks **"French Formulas"** and **"French Formulas ELX"**, brand marks, formulations, and the domain *frenchformulas.com* are the exclusive intellectual property of **French Formulas LLC** (Wyoming, USA) and are utilized by **French Formulas UG (haftungsbeschränkt)** under a formal licensing agreement. Any reproduction or use without prior written consent is strictly prohibited.
14. Dispute Resolution
The European Commission provides a platform for Online Dispute Resolution (ODR): [https://ec.europa.eu/consumers/odr](https://ec.europa.eu/consumers/odr). We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
15. Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in another country, mandatory consumer protection regulations of that country remain unaffected.
16. Amendments to these Terms
The version of these Terms and Conditions published at the time of your order shall apply to your purchase.
